# Key terms in plain language

Key terms in plain language. An explanation of the Terms of Service, not a contract.

This is a short explanation of the [Terms of Service](https://docs.itradingbot.net/company/term-of-service), the [Futures Agreement](https://docs.itradingbot.net/company/futures-agreement), the [AML Policy](https://docs.itradingbot.net/company/aml-policy), the [Fee Schedule](https://docs.itradingbot.net/company/fee-schedule) and the [Privacy Policy](https://docs.itradingbot.net/company/privacy-policy). It is provided for convenience, is not part of the contract, does not replace it and creates no obligations beyond the documents themselves. This page is not one of those documents: only the full text of the Terms of Service, the Futures Agreement, the AML Policy, the Fee Schedule and the Privacy Policy is binding, and in case of any discrepancy between this page and those documents the documents prevail (Terms of Service, Section 2.4). The sections where each point is set out in full are given in brackets.

1. **ITradingBot is software, not an exchange and not a manager.** We provide a terminal, robots and tools. We do not execute or match orders, do not hold or manage your assets and do not give investment advice. Signals, presets, backtests, statistics and default parameters are tools, not recommendations; past results do not guarantee future results and all trading decisions are yours (Section 15.7). "Exchange Account" is our name for a sub-account at Bybit, not an exchange (Sections 1.1, 1.2, 1A.1).
2. **Two modes.** In API Connection Mode you trade on your own exchange account through your own keys. In Exchange Account Mode you trade on a sub-account opened for you at Bybit under ITradingBot's master account; that sub-account forms part of ITradingBot's account structure at Bybit. Your contract for the Exchange Account is with ITradingBot, not with Bybit, and ITradingBot is your point of contact on all matters concerning the Exchange Account; ITradingBot is not a party to your trades and does not match or execute orders; ITradingBot does not represent that you become a Bybit customer, and if Bybit requires you to accept its own terms, we will tell you (Sections 1.1, 1A.1, 1A.1a).
3. **Bybit holds your assets.** ITradingBot has no blockchain wallets, addresses or private keys of its own; its only instrument is Bybit's API. Assets of different users are not mixed, and ITradingBot's own funds are not kept on user sub-accounts. A withdrawal technically passes through two steps inside Bybit: from your sub-account to ITradingBot's master account and then to your address; each step is recorded (Section 1A.2).
4. **All trading decisions are yours.** ITradingBot acts only on your authenticated instructions, including the settings of your robots, and does not decide when or what to trade. Without your instruction ITradingBot does not initiate deposits, transfers or withdrawals, except where Bybit, applicable law (including sanctions and anti-money-laundering requirements) or a competent authority requires it, and in the single case of its own in point 14. Automated strategies can trade faster and more often than manual trading and can cause losses, liquidations and fees without further confirmation from you. You bear the risk of loss, including a total loss of your balance and liquidation (Sections 1A.3, 1A.10, Futures Agreement Section 2).
5. **Identity verification** is required only for Exchange Account Mode. It is performed by our provider before an Exchange Account is opened and may be required again (for example when your document expires, you lose access to your authentication factors, or Bybit requires it). ITradingBot may at any time ask for additional information, including the source of your funds, and may restrict or end the Exchange Account Services if it is not provided or verification fails. Before we refuse service, a "declined" or "needs review" verification result and any screening hit are reviewed by a person; you may contest a refusal and provide further documents (Section 1A.6, AML Policy Sections 5 and 6).
6. **Who cannot use the service.** Persons under 18; residents of the countries and territories in Annex A of the AML Policy (including the United States, Canada, the Netherlands, Malaysia and the temporarily occupied territories of Ukraine); persons located in mainland China, Hong Kong, Singapore or Uzbekistan while using Exchange Account Services; nationals of the United States, Iran and the DPRK regardless of residence; persons subject to sanctions; politically exposed persons; and, for Exchange Account Mode, residents and nationals of any country Bybit does not serve. The service is for natural persons trading their own funds only. If you fall into one of these categories you must stop using the platform and withdraw your assets (Sections 2.1, 2.2, 2.3, 2.4, 2.6, 1A.9).
7. **Account security.** You are responsible for keeping your account access and authentication factors (PIN, authenticator app, passkey, recovery codes) safe, and for everything done with them if they leak; report any unauthorised access to support immediately (Section 7, Futures Agreement Section 4.4).
8. **Withdrawals.** Only you can request one, after multi-factor authentication, and only to an address registered for your Exchange Account at your request; a new address becomes usable after a security delay (currently 48 hours). Before a request is sent to Bybit we check it against a closed list of six grounds (authentication not completed; address not registered; a Bybit restriction; a requirement of law or an authority; reasonable suspicion that your account is compromised; a negative balance or an amount outstanding under point 14) and we cannot change the address or the amount. A request may be held or declined only on those grounds, and unless the law prohibits it we tell you the reason within two business days. Requests that pass are sent to Bybit no later than the next published processing window; after that Bybit's network, compliance and risk controls apply, and ITradingBot does not guarantee the timing of processing by Bybit or by any blockchain network (Section 1A.4).
9. **Bybit can freeze assets** under its own rules, for example on a suspicious deposit. We pass Bybit's requests to you and your answers to Bybit, but we cannot overrule Bybit. If Bybit does not release assets, becomes insolvent or ceases operations, your claim lies against Bybit; whatever Bybit returns in respect of your account we pass on to you without deduction other than as required by law, together with the records we hold to support your claim (Sections 1A.5, 16.5).
10. **When we can suspend or end your access.** If you breach the Terms of Service or use the platform to harm us or third parties, ITradingBot may suspend or end your access at its discretion and without prior notice; the same applies if identity verification is not passed or Bybit requires it. Suspension does not affect your ownership of your assets: in API mode your exchange account is untouched, and in Exchange Account Mode point 11 applies (Sections 12.3, 13, 1A.6, 1A.11).
11. **Withdrawal-only mode.** If we suspend or end your access, the Exchange Account is kept in withdrawal-only mode for at least 30 days (subject to Bybit's rules and applicable law): robots are stopped and new orders, strategies and deposits are not accepted, but you can cancel orders, close positions and withdraw to a registered address. ITradingBot does not close your open positions unless you instruct it. If you lose access to your authentication factors, write to support: after re-verification we restore your access or process a withdrawal to an address previously registered for you. Withdrawals are possible while Bybit keeps ITradingBot's master account and your Exchange Account operational; if Bybit suspends them, ITradingBot cannot guarantee access to your assets and will pursue their return as described in point 9 (Section 1A.8).
12. **Suspension of trading and transfers.** ITradingBot may suspend trading and transfers where Bybit requires it, where it reasonably suspects that the account is compromised or is being used in breach of the Terms of Service or the law, or where a competent authority requires it. You must respond to reasonable requests for information and documents (including the source of your funds); without an answer the Exchange Account may remain restricted by Bybit. Withdrawals may be held only on the grounds in point 8 (Section 1A.11).
13. **Spot and collateral.** The Exchange Account is a unified account: the coins Bybit supports as collateral (always including USDT and USDC) serve by default as margin for your derivatives positions and may be sold in a liquidation. You choose which other coins count as collateral in your settings, and it is your responsibility to check them before opening derivatives positions; ITradingBot does not change your collateral settings on its own. The platform gives no access to Bybit's spot margin or borrowing facilities on Exchange Accounts; ITradingBot does not lend and does not provide leverage, and leverage on derivatives is Bybit's product under Bybit's rules (Section 1A.12).
14. **The only transfer without your request.** If Bybit charges ITradingBot, or deducts from ITradingBot's master account, an amount attributable to your Exchange Account (for example a negative balance after liquidation, a reversed deposit, a fee adjustment or a compensation claim relating to your trading), you must reimburse it on demand. After notice by e-mail and five business days for you to settle it, ITradingBot may transfer that amount, and only that amount, from your Exchange Account, and will provide Bybit's supporting record on request. You also indemnify ITradingBot against third-party claims arising from your own acts, decisions or omissions (Sections 17.1, 17.2).
15. **Fees.** You pay Bybit's trading fees at the tier Bybit assigns to ITradingBot, plus a platform mark-up; Bybit deducts both at the time of each trade, and ITradingBot does not debit fees from your account. Bybit may change or withdraw the tier at any time without prior notice from us; the mark-up can be changed only by ITradingBot with 10 days' notice. Funding payments, liquidation fees, network withdrawal fees and other Bybit charges are governed by Bybit's rules and are not part of the Fee Schedule; the platform subscription is paid separately. ITradingBot receives remuneration from Bybit under the Exchange Broker Program in relation to trading activity on Exchange Accounts (Sections 1A.7, 14, Fee Schedule).
16. **Subscription.** ITradingBot may change or cancel the trial period at any time. A monthly subscription renews monthly and may be cancelled by either party on 14 days' written notice; an annual one renews for a further 12 months unless either party opts out 30 days before the end of the term. Amounts paid are not refunded; taxes and charges are on you (Sections 11, 12.1, 12.2, 12.4, 14).
17. **Outages and warranties.** The platform is provided "as is", with no guarantee of uninterrupted or error-free operation. During an outage or maintenance your positions remain open on the exchange, and stop-loss or take-profit orders already placed with the exchange are handled by it. In Exchange Account Mode the platform is your only interface to the sub-account: place protective orders with the exchange in advance and keep position sizes you can tolerate during an outage; an order that has not been placed with the exchange is not executed while the platform is unavailable (Section 15, Futures Agreement Section 6).
18. **The liability of ITradingBot, its affiliates and its third-party providers is limited**, in the aggregate, to the greater of the subscription fees you actually paid in the six months before the event and USD 500. The cap covers direct damages, including losses from a compromise of ITradingBot's systems or of its master access to Bybit; indirect damages and lost profits are not compensated. Liability is not excluded for death or personal injury caused by our negligence, for wilful misconduct, gross negligence, fraud or fraudulent misrepresentation, or where the law does not allow it to be limited. ITradingBot is not liable for the acts, decisions, delays, freezes or insolvency of Bybit, or for the operation of blockchain networks, except where caused by ITradingBot's own breach of the Terms; in those Bybit- and network-related events ITradingBot's obligations are the ones described in points 9 and 11. A claim must be brought within 12 months of the date you became aware of its basis, unless the law sets a shorter period (Sections 16.0, 16.1, 16.2, 16.4, 16.5).
19. **Changes to the terms** take effect 10 days after publication on the site or notice to you; continued use means acceptance. Exception: changes to the Restricted Jurisdictions List (Annex A of the AML Policy) apply to Exchange Account Mode immediately (Sections 22, 2.2).
20. **Complaints and disputes.** First send a complaint to <support@itradingbot.net> with the subject "Complaint": we acknowledge it within five business days and answer on the merits within 30 days. Arbitration cannot be started until the earlier of our final response and 60 days from the date the complaint was sent (except for urgent interim relief). The governing law is the law of Seychelles. Disputes are finally settled by SIAC arbitration: seat Singapore, one arbitrator, English, with the expedited procedure where its conditions are met; the award is binding. If you are a consumer, the mandatory consumer-protection rules of your country still apply, including the right to go to the courts of your country where the law so provides (Sections 23.1–23.5).
21. **Language.** The contract is made in English. Translations and summaries, including this page, are published for convenience and do not apply in case of any discrepancy (Section 2.4).
