# Futures Agreement

This Futures Agreement ("Agreement") explains the terms, conditions and risks associated with the use of automated futures-trading tools provided by **ITradingBot Limited** ("ITradingBot"), a software platform for algorithmic trading automation (the "Platform"). By using the Platform's futures-related features, **you confirm that you have read, understood and agreed to this Agreement**. This Agreement forms part of the Terms of Service.

ITradingBot is **not** an exchange, financial institution, investment adviser or asset manager. ITradingBot does not execute or match orders and does not make trading decisions for you. All trades are executed by the connected exchange (Binance or Bybit) under the exchange's own rules. Depending on the mode you use:

* **API Connection Mode** — you trade on your own exchange account through API keys that you create and control;
* **Exchange Account Mode** — you trade on an Exchange Account (a trading sub-account held with Bybit Technology Limited under the Bybit Exchange Broker Program) to which ITradingBot provides technical access, as described in Section 1A of the Terms of Service. In this mode your assets are held by Bybit, not by ITradingBot.

### 1. Nature of the Service

1.1. ITradingBot provides **software-based automation tools** that send trading instructions to third-party cryptocurrency exchanges via API connections.

1.2. ITradingBot **does not hold your assets**. In API Connection Mode your assets remain on your own exchange account. In Exchange Account Mode your assets are held by Bybit on your Exchange Account, a sub-account opened under ITradingBot's master account with Bybit. ITradingBot operates no blockchain wallets, addresses or private keys of its own; transfers and withdrawals you instruct are executed through Bybit's API as steps inside Bybit's systems, as described in Section 1A.2 of the Terms of Service.

1.3. In API Connection Mode, ITradingBot cannot perform withdrawals, internal transfers, liquidations or balance adjustments on your exchange account. In Exchange Account Mode, transfers between the wallets of your Exchange Account and withdrawals to the addresses you have designated are executed by Bybit **only upon your authenticated instruction** transmitted by ITradingBot; ITradingBot does not initiate them of its own accord and has no discretion over your assets.

1.4. The Platform does not execute trades itself; all trades are carried out by the connected exchange under its own rules.

### 2. Personal Responsibility and Risk Awareness

2.1. **Futures trading is highly risky and may result in partial or total loss of capital.**

2.2. By using the Platform, you acknowledge that:

* you fully understand the nature of futures trading and its risks;
* you have sufficient trading knowledge and experience;
* you are solely responsible for all trading decisions, including the parameters of any automated strategy you run;
* you use ITradingBot entirely at your own risk.

2.3. You agree **not to use borrowed funds, credit, or money you cannot afford to lose**.

2.4. You confirm that all operations performed through ITradingBot reflect your own trading intentions. ITradingBot does not provide investment advice or recommendations; signals, presets, backtests and default parameters are informational tools only.

### 3. Margin, Balance, and Liquidation

3.1. You agree to maintain sufficient balance and margin on the exchange account or Exchange Account used for trading to support your futures positions.

3.2. ITradingBot **does not perform forced liquidation**. All liquidations and margin actions are handled **exclusively by the connected exchange**.

3.3. Insufficient margin may lead to rapid liquidation outside of ITradingBot's control. In Exchange Account Mode the Exchange Account is a unified trading account: the assets on it that Bybit supports as collateral (always including USDT and USDC) serve, by default, as margin for your futures positions and may be sold by Bybit in a liquidation. You control which other assets are used as collateral through the collateral settings of the Platform (Section 1A.12 of the Terms of Service).

3.4. Any display errors or delays in ITradingBot do not alter your actual position status on the exchange.

### 4. API Access and Platform Controls

4.1. In API Connection Mode, your API keys remain fully under your control; we recommend creating keys without withdrawal permission. In Exchange Account Mode, the trading API keys of your Exchange Account are issued through the Platform and are used only to transmit your instructions; ITradingBot's master access to the Bybit Exchange Broker account is used to provision Exchange Accounts and to execute your transfer and withdrawal instructions, in accordance with Sections 1A.2, 1A.3 and 17.2 of the Terms of Service; each such operation is recorded.

4.2. If abusive, manipulative or disruptive trading behaviour is detected, ITradingBot may temporarily **suspend your access to the Platform**.

4.3. Suspension by ITradingBot **does not affect the ownership of your assets**. In API Connection Mode it cannot freeze or block assets on your exchange. In Exchange Account Mode you retain the right to withdraw your remaining assets in accordance with Section 1A.8 of the Terms of Service, subject to Bybit's rules and applicable law.

4.4. You are solely responsible for the security of your API keys, your authentication factors (PIN, authenticator app, passkeys) and recovery codes, and your exchange accounts. Loss of your authentication factors may delay your access to the Exchange Account until your identity has been re-verified (Section 1A.8 of the Terms of Service).

### 5. User Conduct Requirements

5.1. You agree to trade responsibly, ethically and in accordance with the exchange's rules.

5.2. Manipulative behaviour, API abuse, market exploitation or activities that disrupt the orderly operation of exchanges or the Platform may result in:

* suspension of access to ITradingBot;
* removal of certain automated features;
* temporary API blocking within the Platform.

These actions do **not** affect the ownership of your assets.

### 6. System Maintenance and Technical Limitations

6.1. During system maintenance, updates or outages your open positions remain open on the exchange, and stop-loss or take-profit orders already placed with the exchange continue to be handled by it. In API Connection Mode you can manage positions directly on the exchange. In Exchange Account Mode the Platform is your only interface, so we recommend placing protective orders with the exchange in advance and keeping position sizes you can tolerate during an outage.

6.2. ITradingBot may experience delays or discrepancies due to:

* network congestion
* exchange API limitations
* system failures
* third-party outages
* force majeure events

6.3. ITradingBot will make reasonable efforts to ensure stable operation but **does not guarantee uninterrupted or error-free service**.

### 7. Service Modification and Termination

7.1. ITradingBot may modify, restrict, suspend or terminate futures-related features at any time when necessary for security, compliance or operational reasons.

7.2. Discontinuation of a feature does not affect your exchange account, your Exchange Account or your active positions on the exchange.

7.3. The Platform may cease supporting a trading pair or asset if such pair/asset becomes unavailable or delisted by the exchange.

### 8. No Warranty and Limitation of Liability

8.1. ITradingBot provides the software **"as is" and "as available"**, without any warranties.

8.2. ITradingBot is not responsible for:

* losses caused by market volatility
* exchange liquidations
* fees charged by the exchange
* incorrect user settings
* API failures
* system delay
* third-party errors
* misunderstanding of trading mechanics
* or any financial decisions made by the user

8.3. You acknowledge that **you bear full responsibility for all outcomes** of using the Platform.

### 9. Governing Terms

9.1. This Agreement is part of the Terms of Service and must be interpreted together with it.

9.2. If you do not agree with any part of this Agreement, you must immediately discontinue the use of ITradingBot futures-related tools.

9.3. In case of any conflict between this Agreement and Section 1A of the Terms of Service in respect of Exchange Account Mode, Section 1A of the Terms of Service prevails.
